DIGITAL MILENIUM COPYRIGHT ACT
(DMCA) NOTIFICATIONS
Information for Rights Owners
If you believe content contained on YouMusic.com has been posted in violation of your copyright (your “exclusive right”), you may send a notice to YouMusic pursuant to the DMCA. For the notice to be effective, it must include the following information:
(i) A physical or electronic signature of you or a person authorized to act on your behalf.
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works have been infringed, a representative list of such works.
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit YouMusic to locate the material.
(iv) Information reasonably sufficient to permit YouMusic to contact you, including an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
(v) A statement that the you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
By submitting a notice under the DMCA, you are swearing under penalty of perjury that your statements are true, and you may be liable for damages, including costs and attorneys’ fees incurred by the alleged infringer if your notice contains misrepresentations.
Information for Recipients of DMCA Notices
If you have received notification that YouMusic received a DMCA takedown notice and you believe the material should not have been removed, you may send a counter notice to YouMusic. For the counter notice to be effective, it must include:
(i) Your physical or electronic signature.
(ii) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
(iii) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
(iv) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if the your address is outside of the United States, for any judicial district in which YouMusic may be found, and that you will accept service of process from the person who provided the DMCA takedown notification or an agent of such person.
By submitting a counter notice under the DMCA, you are swearing under penalty of perjury that your statements are true, and you may be liable for damages, including costs and attorneys’ fees incurred by the alleged infringer if your counter notice contains misrepresentations.
